Acceptable Use Policy (AUP)

1. Introduction

This Acceptable Use Policy ("AUP") governs the use of services provided by 13c.tel ("Provider") and constitutes a binding agreement between you ("Client") and 13c.tel. By using the services, you agree to comply with this AUP and all applicable laws, regulations, and policies. Violations of this AUP may result in suspension or termination of services.

2. Client Responsibility

Clients are solely responsible for all actions performed under their account, whether by themselves or third parties. This includes, but is not limited to, violations of this AUP, the Terms of Service, and any associated fees resulting from security breaches, SPAM, or other misuse.

3. Purpose of Services

The primary purpose of 13c.tel is to provide Clients with reliable, high-availability resources to host their internet services in a secure and efficient environment. Clients are expected to use these resources responsibly and in compliance with this AUP.

4. Network Misuse

Clients are granted access to 13c.tel's public and private networks. Misuse of these networks, including but not limited to interference, unauthorized access, or violation of local, state, or federal laws, is strictly prohibited. Clients assume full liability for all content hosted on their servers. Prohibited content includes, but is not limited to:

5. Sabotage and Abuse

Any form of sabotage, whether intentional or unintentional, is grounds for immediate account termination. This includes, but is not limited to, abuse of remote reboot systems or any action that disrupts 13c.tel's services or network.

6. Private Backbone Network

13c.tel provides a private backbone network for secure data transfer between servers. This network is intended for:

Clients are prohibited from using the private backbone for unauthorized purposes.

7. Network Security

Clients are solely responsible for maintaining the security of their servers. Any additional costs incurred due to a Client's failure to secure their server, including but not limited to monitoring or remediation, are the Client's responsibility.

8. Monitoring and Compliance

13c.tel does not actively monitor server content. Content is reviewed only upon receipt of a complaint. Content violating this AUP, the Terms of Service, or applicable laws will be subject to review and potential removal. Repeated violations may result in account termination.

9. Blacklist Policy

If a Client's use of 13c.tel's services results in the blacklisting or blocking of 13c.tel's IP addresses, 13c.tel reserves the right to suspend or terminate the Client's services. Clients are prohibited from operating services on behalf of entities listed in the Spamhaus Register of Known Spam Operations.

10. IP Addresses

All IP addresses issued by 13c.tel remain the property of 13c.tel. Clients retain no ownership rights and may not transfer IP addresses.

11. IRC, BitTorrent, and P2P

IRC usage is permitted unless it disrupts 13c.tel's services or network. Prohibited activities include:

12. Law Enforcement

13c.tel may disclose Client information to law enforcement agencies when presented with a valid subpoena or court order. Clients will be notified of such requests as permitted by law.

13c.tel reserves the right to refuse service to any individual, group, or business. Services may be discontinued at any time, with or without cause, including for violations of this AUP.

By using 13c.tel's services, you acknowledge that you have read, understood, and agree to this AUP. Failure to comply with these terms may result in suspension or termination of services.
