Terms of Service
Effective Date: February 8th, 2025
1. Acceptance of Terms
By using services provided by 13c.tel ("Provider"), you ("Client") agree to these Terms of Service ("ToS"), including electronic transactions, our Privacy Policy, and dispute resolution in Houston County, Georgia. Services are provided "AS IS" without warranties. Continued use after changes constitutes acceptance.
2. Client Responsibilities
- Clients are solely responsible for all actions under their account, including violations of this ToS or the Acceptable Use Policy (AUP).
- Server security is the Client's responsibility. 13c.tel does not enhance security beyond default OS configurations.
3. Service Provision
13c.tel provides prepaid services contingent on compliance with this ToS and the AUP. We reserve the right to refuse service or renewal at our sole discretion. Rates may change with prior notice.
4. Payment and Fees
4.1. Non-Payment
- Services interrupted for non-payment incur a $13 late fee.
- Data is destroyed 7 days after suspension/charge-back.
4.2. Refunds/Charge-Backs
- No refunds for services rendered. Charge disputes must be reported within 30 days.
- Charge-backs incur a $50 administrative fee.
4.3. Cancellations
- Five (5) days' notice required for cancellations or downgrades.
- Termination fee of $25 applies for late notice.
5. Fraud and Abuse
- Fraudulent accounts are subject to immediate termination. Information is shared with authorities and financial institutions.
- Abuse reports (SPAM, blacklisting) may result in fines ($50) or service termination. Clients must respond within 48 hours.
6. Disclaimers and Liability
SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS, OR NON-INFRINGEMENT. WE DISCLAIM LIABILITY FOR:
- Indirect, incidental, or consequential damages (e.g., lost profits, data loss).
- Downtime, inaccuracies, or inability to use the Services.
Your sole remedy is account cancellation. Liability is limited to fees paid during the claim period.
6.1. Indemnification
You agree to indemnify 13c.tel, its affiliates, and suppliers against claims arising from your misuse of the Services.
7. Support and Maintenance
- Hardware support is limited to ensuring service functionality.
- One (1) free OS reload per billing cycle; additional reloads cost $13.
- Unsupported OS installations require approval and a $20 fee.
8. DMCA Compliance
- DMCA complaints trigger a 48-hour resolution period. Failure to comply results in fines ($20) and service suspension.
- Repeat violations incur a $50 abuse charge and data destruction.
9. Verification and Confidentiality
- Clients must submit government-issued ID for verification.
- Client information remains confidential unless disclosure is authorized.
10. Governing Law
This ToS is governed by Georgia law. Disputes are resolved exclusively in Houston County, Georgia courts. You waive jurisdiction claims elsewhere.
11. Entire Agreement
This ToS, along with posted policies, constitutes the entire agreement. Invalid clauses are revised to reflect original intent; remaining terms stay enforceable.
By using 13c.tel's services, you acknowledge that you have read, understood, and agree to these Terms of Service.
